A White father and son are facing criminal charges after allegedly chasing and firing at D’Monterrio Gibson, a 24-year-old black FedEx driver, who said he was targeted while delivering packages in Brookhaven, Mississippi, on the evening of Jan. 24.  According to affidavits obtained by ABC News, 35-year-old Brandon Case, the son, has been charged with purposely, knowingly and feloniously attempting to cause bodily injury to Gibson after allegedly shooting at his delivery van.  While Gregory Case, 57, is charged with purposely, knowingly and feloniously conspiring with his son to commit aggravated assault after allegedly chasing Gibson with his pickup truck and trying to block him from driving away.  Gregory Case’s attorney, Terrell Stubbs, and Brandon Case’s attorney, Dan Kitchens, did not immediately respond to ABC News’ requests for comment, but according to the Brookhaven Municipal Court, both attorneys entered not-guilty pleas on behalf of their clients.  Gibson was not injured, but his van and some packages were struck with several bullet holes, according to a police report obtained by ABC News dated Jan. 25.     On Feb. 28 and March 1, 2022, D’Monterrio Gibson, 24, swore affidavits at Brookhaven Municipal Court and Lincoln County Justice Court alleging conspiracy to murder and attempted murder, respectively, against white father-and-son duo Gregory and Brandon Case. Gibson says the two men waylaid, chased and shot at him in Brookhaven, Miss., in January as he was doing his job.

    In the affidavits, Gibson alleged attempted murder against Brandon Case and conspiracy to murder against Gregory Case, Gibson’s attorney Carlos Moore told the Mississippi Free Press over the phone on March 11, 2022.

    “Neither the city court judge nor justice court judge has signed a warrant for their arrest,” Moore said today. “And so we are just puzzled about what’s going on; there’s just still seems to be favoritism being shown to the Cases.”

    The Brookhaven Police Department did not immediately arrest the Cases after Gibson reported the case in January. The Cases turned themselves to the police station on Feb. 1, 2022. Law enforcement officials released Brandon Case on a $150,000 bond for an aggravated-assault charge and Gregory Case on a $75,000 bond for conspiracy to commit aggravated assault.

    “It’s evident that Brookhaven (Police Department) is not going to do anything,’ the attorney said. “Justice court has concurrent jurisdiction with Brookhaven municipal court, so we thought that he may get justice over there, but nobody’s doing anything, it seems.”

    “We want equal justice, not Mississippi justice. And we know that had the roles reversed, Mr. Gibson would be sitting in jail now without bond for the attempted murder of one of the Cases,” Moore asserted.

    LINCOLN CO., Miss. (WLBT) – A Lincoln County judge declared a mistrial in the case involving a white father and son, Greg and Brandon Case, charged with attempted murder for shooting at a Black FedEx Driver, D’Monterrio Gibson.

    Circuit Court Judge David Strong declared the mistrial minutes into Day 3 of Thursday’s trial for the father and son.

    Brandon Case and his father, Gregory Charles Case, charged with attempted first-degree murder, conspiracy, and shooting into the vehicle driven by D’Monterrio Gibson in January 2022, sat with their attorneys in a small courtroom full of spectators.

    Defense attorneys asked the judge for a mistrial based upon a key witness in the case, Detective Vincent Fernando with the Brookhaven Police Department. Attorneys representing the father and son said Fernando violated multiple rules in his testimony on Day 2, withheld evidence, and blurted out statements that were excluded in the trial.

    D’Monterrio Gibson’s attorneys naturally objected but spent more time explaining how much they understood the defense’s position. In the end, the judge said he “had no other choice,” but to grant the motion for a mistrial.

    A Mississippi judge declared a mistrial Thursday in the trial of a White father and son charged with attempted murder for allegedly chasing and shooting at a Black FedEx driver making a delivery.

    Brandon Case, 38, and his 59-year-old father, Gregory Case, faced charges of attempted first-degree murder, conspiracy and shooting into a vehicle. They allegedly chased FedEx driver D’Monterrio Gibson for about seven minutes as he was delivering packages on his route in Brookhaven, Miss., on Jan. 24, 2022, and fired at least five shots into his van. Gibson, now 25, said that he had not previously interacted with the men.

    Gibson, who was not injured in the attack, said he was driving a Hertz van at the time but was in his full FedEx uniform. He said he believes that the Cases chased and shot at him because he is Black and thought he didn’t belong in the neighborhood.

    Circuit Court Judge David Strong said the mistrial was due to errors made by a Brookhaven Police Department detective who admitted to improper testimony and sharing information that was not previously disclosed to the legal teams. Detective Vincent Fernando acknowledged under oath Wednesday that he had not disclosed a videotaped statement police had taken from Gibson, and had improperly testified about some guns that were found in the home of one of the Cases and casings nearby.

    A Black former delivery driver in Mississippi who says two white men shot into his work van and then pursued him in a high-speed chase last year has filed a new lawsuit against the men and his former employer, FedEx.

    This is the second civil suit on behalf of D’Monterrio Gibson, and it seeks at least $5 million. The two men were tried for attempted murder and other charges but a judge declared a mistrial this summer.
