Part 1: US Embassy in Santo Domingo is not on good terms with Dominican Government after US Embassy issues fraudulent jus soli document.

Dr. Conspiracy (i.e., Kevin Wayne Davidson) recently published an article titled, Smith safe! on April 23, 2014 in which he indicates that he received an email from the US Embassy in the Dominican Republic which states that, “Please by advised that based on information that we have from the Dominican authorities, Mr. Smith is not facing extradition.”   (NOTE: Dr. Conspiracy opportunely failed to publish a transcript of his email in the article until a reader in the comments section at his blog requested it.  Furthermore, we still don’t know the date that his email was sent; it would be nice to know how long (or fast) it took the embassy to respond to the email.)

I am absolutely facing extradition to Kenya so the statement within the email from the US Embassy cannot be factually accurate and is roundly erroneous.

In part one (1) thru ten (10) here on the WOBIK blog we will lay out in a discussion why the email may contain factually inaccurate or erroneous statement.   Each of the ten parts or segments will provide a unique, or related, and reasonable explanation.

PART ONE

On March 24th, 2014, Dominican President Danilo Medina met with U.S. ambassador James Brewster.  The meeting lasted nearly an hour and took place at the National Palace regarding a Haitian woman named Juliana Deguis who, the day before, was barred (for lack of documents) from boarding a flight to Washington, D.C.

National Immigration Council chair José Ramón Fadul (who is firstly the Ministro de Interior y Policía de la República Dominicana) and Presidency legal adviser Cesar Pina were also present at the meeting.   Mr. Fadul stated that, “No Embassy of any country can grant the Dominican nationality to any person, because that’s Dominican Republic’s sovereign right.”

INTERESTING NOTE:  My bond in the extradition case was paid a number of days before the Dominican authorities released me.   The authorities didn’t allow my releaae until March 24th, 2014.

You may now be wondering to yourself, who is this Haitian woman named Juliana Deguis?   Wait for one moment and let us first enter [Dominican] Constitutional Court Ruling 168-13 which was issued or ordered in late September 2013:

In my own words: Essentially the Honorable Court’s ruling renders that any person living in the Dominican who was born to illegal immigrants, dating as far back as the year 1929, is no longer a Dominican citizen or national and no longer has civil rights.  To be clear, even if you were born in the Dominican Republic to parents who were born in the Dominican Republic you still may be an illegal immigrant if your grandparents were illegal when your parents were born.   Illegal immigrants are now being deported.   The Honorable Court’s ruling applies to all immigrants but is, although perhaps not officially, intended for Haitians.

I myself am pro Dominican and I too believe that the Haitians need to leave, especially the illegals which make up the vast majority of them.  (The Haitian problem is much like the Mexican problem in the United States. )

I will now address the Haitian woman named Juliana Deguis.  Who is she?

She is a Haitian woman (who the outside of the country mainstream media paints as a Dominican of Haitian decent, which is a term that I have never heard a Haitian person use here) who was born in the Dominican Republic in 1984 to two Haitian born parents who were both illegal immigrants.

After the Constitutional Court Ruling 168-13 she became what is being called a Stateless person, i.e., a person who ostensibly is not a citizen of any country.  She was not born in Haiti but she cannot stay in the Dominican Republic so where does she go?  (NOTE: Don’t worry too much, its a game.  Haiti recognizes all of these people as Haitians but the rest of the white-politically-correct-left would like you to believe that these people are all now really and truly Stateless.)

In any event, Juliana Deguis went to the US Embassy and got in…STOP RIGHT THERE, how did she get in?

Americans don’t get in, I’ve been nearly gunned down in the past when approaching the US Embassy in Santo Domingo.   Moreover, the guards at the gates don’t even speak English (btw, the place is like a fortress and takes up what appears to be an entire city block, a large block).   If you are a US citizen in need of help, think twice before approaching the embassy.   In any event, the US Consulate (its located on Maximo Gomez in Santo Domingo) is where you’ll probably finally end up at because it is the only place that at least sometimes answers questions that you might have.  However, the problem (or one of the problems) with the US Consulate is that if you ever go there you’ll discover that there are several gimongous lines, each full of people waiting to get inside.  Why is that, are there Americans in need of dire aide?  No, not really, the place is under siege (a figure of speech) daily as Dominicans attempt to make their way, legally, to to United States.   An American-American (lol!) is something rare at the US Consulate as well as the US Embassy.   Moreover, lots of the employees don’t speak English.

Back to the Haitian woman Juliana Deguis.   In all fairness, she probably got into the US Embassy because she had been on the TV news to a degree and her name was circulating.

The US Embassy recently provided Juliana Deguis with a fraudulent visa (Wikipedia doesn’t like to talk about it).   The visa indicated that her nationality is Dominican, which she is not, and this was done intentionally and with knowledge that she was no longer a Dominican citizen or national.

Moreover, Juliana Deguis did not have a passport and the US Embassy does not issue visas to individuals who do not have passports.

The US Government was attempting to promote Jus Soli (and this isn’t just Birther-Lucas Daniel Smith using the words Jus Soli, it was and is being used by Dominican news outlets) in the Dominican Republic.   The US Embassy’s position is that Juliana Deguis was born, and is, Dominican because she was physically born in the Dominican Republic, on the soil of República Dominicana.

Juliana Deguis then attempted to use the fraudulent visa to secure a Dominican Passport.   However, Dominican authorities would not supply her with a Dominican Passport.  At that point Juliana Deguis then bought (likely purchased by the US Embassy) an airline ticket to fly from the Dominican Republic to Washington, D.C. United States of America.

She was not allowed to board the plane because she did not have a passport and even if she would have had a passport she would still not have been permitted on the plane with the fraudulent visa issued by the US Embassy.

That was just 30 days ago.

As she was attempting to board the plane I was 24 hours away from walking out of jail.

In any event, the US Embassy in Santo Domingo is now not on good terms with Dominican Government and one has to consider this when assessing information now being supplied to the embassy by Dominican authorities.

    possibly they are on bad terms on a number of issues. However there is a detailed history of agreements on specific extraditions. So please have a look here where you can find all the acts concerning all extraditions from SD untill dec 2013. http://www.suprema.gov.do/consultas/jurisprudencia/consulta_decisiones_extradicion.aspx
    90% of these cases are extraditions towards the US of both US and Dominican Citizens.
    So contrary to what you claim about bad relations between US and RD there seems to be a long history of cooperation over extraditions.

    You might as well give up the ruse. It is too easy to check databases and contact people who would know if you were being extradited to Kenya. Kenyan officials say that if they were going to extradite an American citizen, they would not be looking for that person in the Dominican Republic nor would they proceed with extradition from the Dominican Republic. And the “crime” of bribery is not something that they would extradite someone for. It isn’t a serious enough crime.

    A blatant contradiction in your narrative regarding visiting the Embassy. You say that you were nearly gunned down and yet there are lines of people waiting there to get into the United States. According to their website, US Citizens can visit the Embassy and get forms and other documents they may need in the lobby- though it is best to call for an appointment in most cases as their lobbies are often busy. Sure doesn’t sound to me like they’re going to gun anyone down.

    In addition to that, I just checked the requirements for anyone hired to protect the US Embassy in the Dominican Republic and the State Department website has a requirement that anyone hired must have the ability to speak English in addition to Spanish. So, again you lie.

    No, he uses this story to try to say there’s a problem with the US Embassy and the government of the Dominican Republic and that any information obtained from the US Embassy must be false. Unfortunately for Lucas, relations are just fine and the US Embassy did contact the proper authorities in the Dominican Republic to find out if there were any US Citizens being extradited to Kenya.

    Deguis revealed that several organizations helped take her case to court, which was what led to the now controversial ruling.

    Despite having her birth certificate Deguis has been denied a cedula, precisely the document which states nationality.

    “I don’t want any document that doesn’t say that I am Dominican, because I was born and raised here. I don’t know anyone in Haiti and I’ve never been there.”

    Visa uproar

    On the visa granted her by the U.S. last week, Deguis said she received a call from an American Embassy official asking her to go the Consulate the next day.

    She said once there she filled out the form and paid the fee charged by the Consulate and received the visa that same day.

    However she was unable to travel to the hearing of the Inter-American Commission on Human Rights because the Dominican Immigration Agency barred her from boarding the flight for not having a passport.

  21. Mr. Smith asks about the email response time from the US Embassy in Santo Domingo. I sent my email inquiry to the them at 6:55 PM on April 21.

    My inquiry to SDOAmericans@state.gov was answered by an immediate auto-responder message that said:

    Thank you for contacting the American Citizen Services (ACS) Section of the U.S. Embassy in Santo Domingo, Dominican Republic.

    If your inquiry has to do with an American citizen emergency, please call us immediately at (809)221-2171 For after hours emergencies you may also call (809) 221-2171, 24 hours a day, 365 days a year.

    If your inquiry is specific in nature and cannot be answered by the information on our website, we will answer it within two business days. …

    On April 22, I received a manual reply saying that my question had been forwarded to the the “corresponding unit” for review. Finally the published response was received at 2:10 PM on April 23. Getting an answer took 2 days.

    Wow….part 1 of 10. At what point in the series do you start talking about something at least remotely relevant to the question of being extradited?

    But let us address some of the things you raised. First the lines infront of the embassy/consultes. Those lines do not apply to American citizens. I have traveled to man different countries. In most of countries around the world, there are huge lines in front of them. In one of those countries where I had family, a cousin of mine had just had a visa denied. I walked right up to the consulate door, unannounced, right past that huge line, flashed my passport, walked right in, asked to speak to someone about my relative’s denial, and was speaking to someone in consular affairs within half an hour. That is how things work in all US embassies/consulates around the world. The doors open wide for US citizens.

    Point 2: When a citizen is arrested abroad, and requests consular assitance, it is the duty of that country to notify the consulate of the citizen’s home country. This is required by treaty. Granted, some countries are better at following these rules than others (in the US local police often “forget” to tell foreigns they are entitled to contact their consulate), but when a consulate contacts a foreign government about a citizen that has been arrested for any reason, unless the host nation plans on making the arrested person disappear permanently, they’re not going to lie about it. Particularly while there are they are having public hearings about that person, that anyone can attend.

    Your long winded rant about Juliana Deguis is fairly irrelevant for several reasons. First because it’s pretty silly to state the US is trying to force jus soli on anyone, particularly a country that is already jus soli, albeit with restrictions (like a good portion of countries that are jus soli). Now you are correct in stating that the US granted her a visa, without having a passport, and put her down as Dominican. And you were even kind enough to share a picture of her at the air port. What you did neglect to say is that that visa was issued just last month, expires in June, and is for the sole purporse for her to attend the hearings for her case brought before the Inter-American Council of Human Rights, in Washington, DC, about her citizenship. As the seat of the IACHR, the US is obligated to grant a visa to someone with a hearing before it. I’m guessing that fact also helped her cut through the lines as well. I suppose the government could be a tad peeved that the consulate put DOMR as the nationality, but if you really think that’s pushing jus soli (again, on a state that is jus soli with restrictions…just like the UK, Australia, NZ, France, Ireland, and plenty other countries we never really cared about how they apply jus soli…oh, and then all the countries that use jus sanguinis we never cared to pressure to change their ways…like Italy, Israel, and Poland), that’s pretty thinned skinned. There is nothing “fraudulent” about the visa, because, the US can issue a visa to whomever it wishes, and put whatever it wants on its visas. The consulate knew to whom it was issuing a visa, and for what purposes. Again, no fraud there. The only purpose of a visa is to grant a person entry into the US, so again, the consulate can put whatever they want on it to satisfy its own puporses (just like any other government can). Which again, has absolutely nothing to do with you.

    Which now let’s take a look at what you’re proposing. Because the US consulate granted a visa, that it is obligated to by treaty, naming a person’s nationality as DOMR rather than stateless, the government of the Dominican Republic, is going to lie to the US embassy about an American citizen’s extradition status, a matter that by treaty, they are obligated to inform the consulate about. And then, they are going to hold public hearings about that extradition…oh yeah, and the country asking for the extradition is also lying about it, and they never bothered to put you on the Interpol Red Notice either. And now, rather than simply posting any actual evidence of your extradition proceedings (you know, like an extradition request), that also, could be easily confirmed by a simple phone call or email, you’re going create a 10 part series of what so far appears to be entirely irrelevant information, to “prove” you there are extradition proceeding?

    man, anyone who falls for your cons is a real sucker that deserves to be separated from their money….but at least you’re at least funny to watch work (if it wasn’t for the fact that you’ve proudly admitted to being a sexual predator).

  28. I just had time to look through the comments from over the last 12 hours or so. These skeptics posting here are either just pretending to be ignorant or they really are. Just to a few points here:

    1. The US Embassy and the US Consulate are not the same thing and they are located at two different locations.

    2. The guards at the US Embassy don’t speak English. Some of the employees at the US Consulate, inside, don’t speak English.

    3. The lines outside of the US Consulate (I’ve never seen lines at the US Embassy, like I said you are likely to get gunned down. Whether you are American or not you have to wait in a line. There are different lines. Its difficult to understand what’s going on in the lines if you don’t speaks Spanish because you aren’t following going to hear any English. And when you do speak with the people in charge of the lines they want yo know what it is exactly that you want, and if they can help you from there they don’t let you inside. And if you do get inside don’t expect to see any American-Americans (it ain’t like the movies) and then you’ll be shoved in another line inside which is full of people waiting to speak to a Homeland-security-looking guy through what looks like a reinforces glass window from a supermax prison. And the Homeland-security looking guy is not at all friendly, especially if you look like an American-American. Your questions, if answered, will be answers with the lest amount of words and likely something about being able to find the information on line. When realize that you’ve wasted the last 3 hours of your life and you for some unknown hardwired reasons you tell the Homeland-security-looking guy “thank you” (for what, not sure) he looks at you like he wants to tell that you must be pretty f-Ing stupid if you believe that he has helped you with any of the question s that you had when you arrived.

    5. This WOKIK report indicates that DOMINICAN authorities may not be supplying acccrate data and info to the US Embassy. Nowhere was if stated that it was being indicated that US embassy lied in the letter to Dr. C.

    1. Of course the Embassy and the Consulate are different. The Embassy is, basically, the Ambassador’s Office. The Embassy deals with the host government as a representative of the United States. Consular Services are part of most Embassy compounds. There are also agencies/offices, in other locations, that can provide certain services. One of the most important things to do, as an American citizen who needs consular services, is make an appointment through the website or over the phone. That is true throughout the world. In the Dominican Republic there are 2 agency offices, along with the main Santa Domingo location.

    2. Everyone who works at the Embassy,or at a consular agency, interacting with the public must speak,read and write English at level 3. This is a working comprehension of the language( Can read a newspaper, write a coherent letter to the editor and talk about the articles with others). The guards must also speak,read and write in Spanish at level 4 in the Dominican Republic. Native speaking ability is level 5.

    3. No guard will gun you down unless you give them cause. Maybe you give off a creepy, shifty, pedo vibe in person. Bureaucrats who give simple gruff answers to questions they have answered hundreds of times? The hell you say! Of course, if you really “wasted 3 hours waiting in line” when a 5 minute site search would have answered your question, then your pitiful con jobs make sense. Your lack of Americans ( WTF are American-Americans?) in the office claim is strange. I have been to, or contacted, Consular Services in Japan, Korea, Vietnam, and Hong Kong within the last 5 years. All had American staff members. Strange that a country so close to America wouldn’t.

    As was pointed out by me and BobJ, guards are the US Embassy are required to know English. They are hired by the US State Department and if you go to the US State Department’s website, they clearly list the requirements to be hired on as a guard to their Embassy in the Dominican Republic as being fluent in English and Spanish.

    The Embassy IS NOT off limits to US Citizens and you’re not going to get shot by approaching the Embassy unless you are approaching in a threatening manner or maybe trying to drive a vehicle through their gates. Their website says US Citizens can visit the Embassy and get documents in their lobby they may need but if you need help on a specific matter it is best to get an appointment prior to your visit unless you want to wait to see someone.

    Further more, there are more holes in your story than a slice of swiss cheese. You claimed earlier that government agencies were off for a holiday and yet you attended a court hearing that was supposedly on your behalf during that same week when everyone was off for a holiday.

    Then, it was pointed out that particular court that you attended does not hear matters that deal with extradition. So there was no way an extradition hearing was even taking place.

    But the most hilarious part is you post a video where you write that the Judges are interviewing the supposed police officer from Interpol regarding your extradition. But when someone that knows Spanish listens to it and they hear nothing about you or your extradition. They say they are questioning a person regarding his past employment and he used to work in upholstery. (Oh, but the video was conveniently cut off PRIOR to them getting to your hearing – so you changed your story.)

    You can write the remaining part of your series but in the end it won’t change the FACT that the country of Kenya is not extraditing you for a petty crime of bribery and I write petty because I doubt you could have come up with more than the same amount you claimed you paid another person to get you your first fake birth certificate (you know, the first one your forged). They would probably extradite you if you had bribed an official and the amount was into the hundreds of thousands of dollars but the fact is, you’re not wanted in Kenya. They’ve never heard of Lucas Daniel Smith from the United States. You haven’t ever set foot on the continent of Africa.

When Lucas LOL at the official records of the Dominican Supreme Court that count 7 extraditions in 2013 he is in fact believing that many, probably hindreds, of EXPULSIONS should be counted as well. This leads him to argue that the SC is biased and is hiding a far greater number. Lucas is telling us that he is undergoing an extradition process with two cuntries envolved, Kenya and Santo Domingo. A similar case falls under the exclusive jurisdiction of the Dominican Supreme Court as stated by the Dominican Codigo Penal art. 70, point 6.
    Now Bruce, instead of proposing medals of honor, might as well put himself in contact with the Dominican Supreme court or the US Embassy.
