{"id":3648,"date":"2013-06-26T01:19:39","date_gmt":"2013-06-26T05:19:39","guid":{"rendered":"http:\/\/www.wasobamaborninkenya.com\/blog\/?p=3648"},"modified":"2013-06-26T01:49:59","modified_gmt":"2013-06-26T05:49:59","slug":"update-on-the-columbia-university-case-regarding-caucasians-from-iowa-only-scholarship","status":"publish","type":"post","link":"https:\/\/www.wasobamaborninkenya.com\/blog\/update-on-the-columbia-university-case-regarding-caucasians-from-iowa-only-scholarship\/","title":{"rendered":"Update on the Columbia University case (154375-2013) regarding Caucasians from Iowa only scholarship."},"content":{"rendered":"<p><span style=\"color: #000000;\">As readers may know I filed what I styled as a<\/span> <span style=\"color: #0000ff;\"><a href=\"http:\/\/www.wasobamaborninkenya.com\/blog\/uncategorized\/05-31-2013-memorandum-in-opposition-to-petition-lucas-daniel-smith-columbia-university-supreme-court-of-the-state-of-new-york-new-york-county-index-no-154375-2013\/\" target=\"_blank\"><span style=\"color: #0000ff;\">Memorandum In Opposition To Petition<\/span><\/a><\/span> <span style=\"color: #000000;\">last month, May 31, 2013, in a case (a petition) in the Supreme Court of the State of New York, New York County which was brought by JPMorgan Chase Bank, N.A.\u00a0 Their petition seeks to modify the <\/span><em><span style=\"color: #000000;\">Lydia C. Chamberlain Trust<\/span><\/em><span style=\"color: #000000;\"> (1920) because the trust awards scholarships, at Columbia University, to only those candidates who are both Caucasian and born in the State of Iowa (there are several other stipulations and prerequisites, as well).<br \/>\n<\/span><\/p>\n<p><span style=\"color: #000000;\">I made the mistake of filing my Memorandum via the US Postal Service mail.\u00a0 I have since been informed by the attorneys representing JPMorgan Chase Bank, N.A. that any additional papers I may wish to submit in the case must be e-filed.<\/span><\/p>\n<p><span style=\"color: #000000;\">Attorney Elizabeth A Candido (of Mazur, Carp &amp; Rubin, P.C.) also informed me that the June 5th, 2013 hearing was adjourned for 60 days, to August 5th, 2013.<\/span><\/p>\n<p><span style=\"color: #000000;\">I&#8217;m grateful that the Honorable Court, and even the attorneys at Mazur, Carp &amp; Rubin, P.C., who represent JPMorgan Chase Bank, N.A., have given me 60 days to prepare and submit a full brief.<\/span><\/p>\n<p><span style=\"color: #000000;\">It appears that it is possible that a non attorney<\/span> <em><span style=\"color: #000000;\">pro se<\/span><\/em> <span style=\"color: #000000;\">party can choose to not use the e-filing system but that they must notify the Court.\u00a0 I&#8217;m not sure if that is as easy as it sounds though.\u00a0 In any event, the letter from attorney Elizabeth A Candido states that I must file e-file and besides, I&#8217;d rather e-file in this particular case anyway because e-filing appears to be uncomplicated, efficient and timely.\u00a0 I am now in the process of applying for a User Name and Password which will permit me to e-file papers in this particular case (no other cases).<\/span><\/p>\n<p><span style=\"color: #000000;\">The 06.06.2013 letter (although the postmark says 06.14.2013) from Mazur, Carp &amp; Rubin, P.C., is embedded below for review:<\/span><\/p>\n<p style=\"margin: 12px auto 6px auto; font-family: Helvetica,Arial,Sans-serif; font-style: normal; font-variant: normal; font-weight: normal; font-size: 14px; line-height: normal; font-size-adjust: none; font-stretch: normal; -x-system-font: none; display: block;\"><a style=\"text-decoration: underline;\" title=\"View 06.06.2013 letter from Mazur Carp &amp;amp; Rubin, P.C. to Lucas Daniel Smith.
