Smith, Chairman and Founder &#8212; <a href=\"http:\/\/www.ifs.org\/about\/staff\/bradley-a-smith\/\">http:\/\/www.ifs.org\/about\/staff\/bradley-a-smith\/<\/a><\/h6>\n<p><strong>===================================<\/strong><\/p>\n<h3><strong>American Thinker<\/strong><br \/>\nby Thomas Lifson<br \/>\n4\/11\/2018<\/h3>\n<p><strong>Excerpt:<\/strong><\/p>\n<div class=\"article_body\">\n<p><em>Bradley Smith has thoroughly debunked one of the rationales for the seizure of attorney-client privileged communications in attorney Michael Cohen&#8217;s office on suspicion of violation of federal election laws.\u00a0\u00a0One<a title=\"\" href=\"https:\/\/www.americanthinker.com\/blog\/2018\/04\/former_federal_election_commission_chairman_debunks_pretext_used_for_raid_on_trump_lawyer.html#_edn1\" name=\"_ednref1\">[i]<\/a> of the allegations is that the hush money paid to Stormy Daniels amounted to an in-kind campaign contribution, far exceeding the amount permitted an individual to contribute.\u00a0\u00a0Smith demonstrates that this is nonsense in his Wall Street Journal <a href=\"https:\/\/www.wsj.com\/articles\/stormy-weather-for-campaign-finance-laws-1523398987?emailToken=72223bbcb77ec7ac2738f3dce949322c4GvR%2FSBTxPiwWaRuxYkm8MZ7PQJkAREMgH86ZMO5Pxf%2BS5b4e9gqJMLeyIIrtx6Oc4IjWcDrLrvySYd8B%2B2Pg%2BDDQj%2FahQixghUjauZ1oaI%3D\">column<\/a>, titled &#8220;Stormy Weather for Campaign Finance Laws.&#8221;<\/em><\/p>\n<blockquote><p>Campaign-finance law aims to prevent corruption.\u00a0\u00a0For this reason, the FEC has a longstanding ban on &#8220;personal use&#8221; of campaign funds.\u00a0\u00a0Such use would give campaign contributions a material value beyond helping to elect the candidate \u2013 the essence of a bribe.<\/p>\n<p>FEC regulations explain that the campaign cannot pay expenses that would exist &#8220;irrespective&#8221; of the campaign, even if it might help win election.\u00a0\u00a0At the same time, obligations that would not exist &#8220;but for&#8221; the campaign must be paid from campaign funds.<\/p>\n<p>If paying hush money is a campaign expense, a candidate would be\u00a0required\u00a0to make that payment with campaign funds.\u00a0\u00a0How ironic, given that using campaign funds as hush money was one of the articles of impeachment in the Watergate scandal, which gave rise to modern campaign-finance law.<\/p>\n<p>When the FEC adopted these regulations, it specifically rejected a rule under which campaign contributions could fund an expenditure &#8220;related to&#8221; a candidacy.\u00a0\u00a0The FEC was concerned that would make it too easy for candidates to use campaign funds for personal benefit.\u00a0\u00a0Personal debts, for example, are &#8220;related to&#8221; the campaign \u2013 if unpaid, the candidate&#8217;s reputation might suffer.\u00a0\u00a0A Rolex watch, a new suit, or a haircut might help a candidate look good on the trail.<\/p><\/blockquote>\n<\/div>\n<div>\n&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;.<\/div>\n<p><strong>View the complete article including links and\u00a0 comments at:<\/strong><\/p>\n<p><a href=\"https:\/\/www.americanthinker.com\/blog\/2018\/04\/former_federal_election_commission_chairman_debunks_pretext_used_for_raid_on_trump_lawyer.html\">https:\/\/www.americanthinker.com\/blog\/2018\/04\/former_federal_election_commission_chairman_debunks_pretext_used_for_raid_on_trump_lawyer.html<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Image source: Institute for Free Speech, Bradley A.
