    Salon writer Matthew Rozsa, Ph.D., writes that Canadian-born Senator Ted Cruz is a naturalized citizen of the United States and is eligible to be President. I guess there was no need for all those failed attempts to amend Article II to allow naturalized citizens run for POTUS. Do you hear that Arnold? You can now be President.

    Before we continue on to deconstruct the long, inglorious history of right-wing double standards, let us dispel any notion that Cruz’s place of birth disqualifies him for the presidency. Although Section 1 of Article 2 in the Constitution indeed states that only “a natural born Citizen, or a Citizen of the United States, at the time of the Adoption of this Constitution, shall be eligible to the Office of President,” Section 301(c) of the Immigration and Nationality Act automatically extends naturalized citizenship to anyone born of an American citizen. Because Cruz’s mother, Eleanor Wilson, was born in Delaware, the senator from Texas without question passes Constitutional muster. [...] Salon.

    Obama ineligibility litigant David Farrar schooled the writer in the Salon comment thread:

    Anytime anybody wants to get the word about Sen Cruz trashing the US Const in his race to the presidency, please let me know. I am a Republican Tea Party "Birther and have a long, long record going after Obama in court and here in the blogosphere on the same or similar grounds.

    But this isn't the game being played out be you today in the Case of Sen Cruz. Although the left would like you to believe the Right is keeping mum about Cruz's unqualification to take the oath of office of the presidence of the United States, if elected; they dare not do it too loudly themselves because the truth is both the Left and the Right want to publish as little as possible on this trashing of the US Const., while still managing to smear the other side for not doing so. -- least their own supporters might start asking embarrassing questions.

    SEN. TED CRUZ IS NOT A BORN CITIZEN OF THE UNITED STATES BY NATURE

    John Jay, long ago, cleared up the apparent ambiguity associated with Sen. Cruz's presidential run by adding the additional requirement that the citizen-candidate be a citizen of the United States by nature, not by statute.

    "All the sources routinely used to interpret the Constitution confirm that the phrase “natural born Citizen” has a specific meaning: namely, someone who was a U.S. citizen at birth with no need to go through a naturalization proceeding at some later time".

    Unfortunately, Sen Cruz does not fit this bill, as he admits: "I am a born citizen of the United States by statute: Title 8 U.S.C. Sec. 1401(g)."*

    There are only two ways to become a born citizen of the United States, either by nature or by statute (that is any law that is man-made). Ted Cruz is a born citizen of the United States by statute, i.e. naturalization. In fact, without the provisions of Sec. 301 (a), para. (7), Sen Ted Cruz would not be a citizen of the United States at all; he would be a Canadian citizen, as was his father at the time of Ted's birth. This would not be true if Sen Cruz was, in fact, a born citizen of the United States by nature.

    As far as the "need to go through a naturalization proceeding at some later time" goes, Congress has the authority to create US citizens by its naturalization authority. It can create any type of naturalization procedure it needs to accomplish this responsibility, as long as the statutes they pass are uniform throughout the states.

    Sec. 301 (a), para. (7) is a "naturalization" statute, pure and simple.

    * Sen Cruz misquotes the actual controlling naturalization act in Obama was assumed to be born within the jurisdiction and so would come under the 14 Amendment.

    If being born abroad to just one (or even two) U.S. Citizen parent(s) is enough to confer "natural born Citizen" status how come in 2004 Senator Don Nickles, Senator Mary Landrieu, and Senator Jim Inofe submitted a Senate Bill to redefine "natural born Citizen" to include any person born abroad to either one or two U.S Citizen parent(s)!?
